Louisiana and the Death Penalty
Louisiana is one of a handful of states that still uses capital punishment. Defendants convicted of certain types of homicide (homicide committed during aggravated rape, aggravated arson, or armed robbery, for example) potentially face the death penalty. Louisiana has, however, seen a strong decline in the state’s desire to rely on capital punishment.
Even though the death penalty remains on the books, very few executions actually occur. The last execution in Louisiana was carried out in 2010, more than a decade ago. The U.S. Supreme Court has held that the death penalty cannot be used in non-homicide crimes. Moreover, the Supreme Court previously ruled that Louisiana cannot have a mandatory death penalty even for certain types of murder; the court must have the opportunity to consider mitigating factors. The actual means of execution–the state’s lethal injection procedures–have also been challenged, preventing any executions from actually taking place. It’s important to know that capital punishment is technically an option, but it’s reserved for only the very worst murders and actual execution is unlikely.
