Changes to Louisiana’s DWI Laws

Louisiana has grappled with a persistent issue of drunk driving, consistently ranking among the states with the highest alcohol-related traffic fatalities. Key Provisions of the New Legislation

Increased Penalties for High BAC Offenders

The law enhances penalties for DWI offenders with blood alcohol content levels of 0.15% or higher. These offenders will face mandatory jail time, with a minimum sentence of 48 hours for first-time offenders and 96 hours for second-time offenders.

Restricted or Hardship Driver’s Licenses

The bill eliminates the waiting period drivers previously had to wait before returning to the road after being charged or convicted of DWI with the issuance of a restricted or hardship license and ignition interlock device. Those convicted of a DWI will have their driver’s license suspended but may receive a restricted or hardship license when they agree to install an ignition interlock device.

DWI offenders with a blood alcohol content of 0.15 or less and proof of the installation of an ignition interlock device will be awarded a restricted license. In contrast, those with blood alcohol content over 0.15% will be granted a hardship driver’s license upon installing an ignition interlock device. License suspension is reduced when drivers achieve a history of sober driving.

To receive a provisional driver’s license, the new law mandates the installation of ignition interlock devices for DWI offenders. These devices require drivers to provide a breath sample before starting their vehicles, preventing them from operating if their blood alcohol content exceeds the legal limit.
